The following is transcribed from a copy in the Public Record Office at Kew (Prob 11/824)
In the Name of Amen Q:x: Robert Harvey of Stoke Ferry in the Country of Norfolk Grocer being of health in Body and of sound and perfect Mind and Memory thanks be given to Almighty God for the same do make this my last Will and Testament in Manner and form following and first my Will is that my Executors hereby after named shall well and truly pay off any lawful Debts that I shall owe at the time of my Decease and all my Legacies herein after given by this my Will then I do hereby name constitute and appoint my loving Brother Will Harvey of Fincham Clerk and Mr Leonard Weasenham of Runton Holme both in the County of Norfolk Gentleman my Brother in Law Executors of this my Will then I do hereby give unto the poor of the Parish of Stoke Ferry aforesaid the sum of two Pounds and to the poor of the Parishes of Wretton, Boughton and Chimplesham all in the said County of Norfolk twenty shillings a piece to be forthwith distributed amongst the poor of each parish in such manner as my said Executors shall think proper then I do hereby give unto Mary my loving Wife one Bedstead with Green Camblot hangings one feather Bed and Bolster and two pillows to the same belonging six chairs one large . . . one Easy Chair and chest of Drawers and Dressing Table and the Looking Glass over the same all now standing and being in the Chamber over the Great Parlour belonging to the House . . . now dwell also two pair of Sheets two large Silver Spoons and six Silver Tea Spoons to be delivered to her my said Wife by my Executors immediately after my decease and to be disposed of to any of her Children which she shall think proper then I do further give unto the said Mary my Wife one Annuity or yearly sum of ten pounds of good and lawful money of Great Britain to be paid to her the said Mary my Wife or her Assigns during the Term of her natural Life at the four most usual feasts or days of payment in the Year that is to say at the feasts of Saints John the Baptist, Saint Michael the Archangel the Nativity of our Lord Christ and the Amnurations of the Blessed Virgin Mary by even and equal parts the first payment to be made on such of the feast days as shall first happen after my decease and all and every such payment to be without any deductions or Abatement whatsoever the said Annuity or yearly sum of ten pounds to be in full barr and satisfaction of all . . . and Thirds at the Common Law which she my said Wife shall or may claim or demand of the Estate or any the Lands Tenements or Hereditaments whereof or wherein I shall be served or possessed at the time of my Decease and also in full payment and Discharge of the like sum of ten pounds a year served or intended to be served to be paid her my said Wife for her Life by virtue of a certain Bond made before my Marriage with her I do hereby give and bequeath unto my Son Robert Harvey the Sum of three hundred pounds to be paid him by my Executors twelve Months after my Decease / which with what I have already given him and what he will enjoy at the Death of his Mother is all . . . him by this my Will ) and provided always and my Will is that in case any of my Messuages Lands or Tenements or Hereditaments holden by Copies of Court Roll and hereinafter given and devised to my said Executors to be sold for the purposes hereinafter mentioned or any part thereof shall not be surrendered to the use of my Will and he my said Son Robert Harvey or his heirs at at Law shall claim the same as heirs or shall refuse to join with my said Executors in the Sale thereof then and in such case I do hereby give and bequeath the said Legacy of three hundred pounds hereinbefore given to him my said Son Robert Harvey unto my Son William Harvey and unto my Daughters Mary Harvey, Elizabeth Harvey, Ann Harvey, and Susan Harvey, to be divided amongst them part and share alike any thing hereinbefore contained to that contrary thereof in any wise notwithstanding then I do hereby give and bequeath unto my said Son William Harvey the Sum of five hundred pounds of like lawful Money to be paid to him by my said Executors within twelve Months next after my Decease then I do hereby give and bequeath unto my said Daughters Mary Harvey, Elizabeth Harvey, and Ann Harvey, to each of them my Daughters the sum of one thousand pounds apiece of like lawful Money to be paid to them by my Executors within twelve months next after my Decease then I do hereby give and bequeath unto my Daughter Susan Harvey the sum one thousand pounds of like lawful Money to be paid to her by my said Executors when she shall attain the her Age of twenty four years but in case she my said Susan Harvey shall have attained that Age at the time time of my decease then and in such case I do hereby order and direct that my said Executors shall not pay her said Legacy until twelve Months next after my Decease and in case my said Son William Harvey or any of Daughters Mary, Elizabeth, Anne and Susan Harvey or any or either of them shall happen to die before his her or their Legacy shall become due and payable as aforesaid without leaving lawful Issue then and in such case I do hereby give and bequeath the Legacy or Legacies of him her or them so dying as aforesaid unto the Survivors of them my said Son and Daughters and also unto my said Son Robert Harvey to be divided amongst them part and share alike them all and every my Messuages Lands Tenements and Hereditaments whatsoever and wheresoever as well freehold as copyhold together with their and every of their Appurtenances and also all and singular my Goods Chattels Store in Trade, Corn, Cattle household Goods, furniture Silver and Plate Except such Plate as is marked with the initial Letters of the Name or Names of any of my said Children which I do hereby give to them respectively and to be delivered to them by my Executors immediately after my Decease / Bills Bonds Notes of Land Mortgages\s ready Money Debts and all other my personal Estate of what kind or Nature soever (not herein before bequeathed) I do hereby give devise and bequeath unto my said Executors the said William Harvey Clerk and Leonard Weasenham and to the survivor of them and to the Heirs Executors and Administrators of such Survivor upon Trust and to and for the several uses Intents and Purposes hereinafter expressed and declared (that is to say ) that they my said Executors or the Survivor shall as soon as conveniently can be after my Decease sell and dispose of all and every of my said Messuages a Lands Tenements and Hereditaments and also of all and singular my said personal for the best price and prices that can or may be got for the same and after sale of my said real and personal Estate shall in the first place put out to interest in their or one of their Names on Land or to her good security so much of the Moneys arising by such Sale as the Interest thereof shall or may be sufficient to pay and satisfy the said Annuity or Yearly Sum of ten pounds herein before given and bequeathed to the said Mary my Wife for her Life by this this my Will and from and after her Decease I do hereby give and bequeath the said Principal Money so placed out at Interest as aforesaid unto my said Sons Robert Harvey, Will Harvey, and unto my Daughters Mary, Elizabeth, Anne and Susan Harvey, to be divided amongst them part and Share alike and that they my said Executors shall in the next place by and with the Moneys arising from the sale of my said real and personal Estates pay and satisfy thereout my financial Expenses all my Debts which I shall have at the time of my Decease and all my Legacies herein before given by this my Will. And from and after payment of my said financial Expenses Debts Legacies it is my Will and and Desire that the Surplus Money (in case any such there be) shall be divided into six equal parts by my said Executors and I do hereby give one sixth part of the said surplus (Insert to side - Unto my Son William Harvey anther sixth part thereof ) Money unto my Daughter Mary Harvey another sixth part thereof unto my Daughter Elizabeth Harvey another sixth part unto my Daughter Anne Harvey another sixth party thereof unto my Daughter Susan Harvey and I do hereby order and direct that my said Executors and Administrators of such survivor shall in their or one of their Names place out at Interest the remaining sixth part of the said Overplus Money and shall pay the Interest thereof yearly unto my Wife Mary for and during her natural Life and from and after her Decease I do hereby give the said remaining sixth part of the said Surplus Money unto my Son William and my Daughters Mary, Elizabeth, Anne and Susan Harvey, or to such of them as she the said Mary my Wife shall by her last Will and Testament in Writing direct and for want of such direction as aforesaid to be equally divided amongst them part and share alike it is my desire and I do hereby request my friend Thomas Thomas Topper of Wattlington in the said County of Norfolk Grocer to aid and assist my Executors in the sale of my Store in Trade and I do desire that the said Thomas Topper should be fully satisfied by said Executors for his Trouble there therein then I do hereby request that my two Executors before named will accept of five Guineas each as an acknowledgement for their Great Trouble they must be at in the said Executorship and my Will is that it shall may be lawful to keep and retain the same and also all such Moneys Costs Damages and Expenses as they or either of them shall sustain suffer expend or be put to in suites at Law or Equity travelling Charges or otherwise by reason of this my Will and that my said Executors shall not be answerable for each other or for the Receipt Of or Default of each other any thing contained in this my Will to the contrary thereof in any wise notwithstanding. And Lastly I do desire to be buried in the Churchyard of Stokeferry aforesaid at the East End of the Church there and that a Stone should be fixed upright in the Wall with only my Name Age and time of Burial thereupon but that the same should be large enough to Express the like if my Wife should when she departs this Life desire to be buried near me and I do hereby revoke all former Wills whatsoever by me made in Witness whereof to this my last Will and Testament contained in two Sheets of Paper one of them wrote of both sides of the paper and paged in the Top one, and the other two and this the third and to each sheet have put my hand and Seal this thirteenth day of July in the year of our Lord one thousand seven hundred and fifty four ___ R.Harvey __ Signed Sealed Published and Declared by the above named Robert Harvey the Estator to be his last Will and Testament in the Presence of us who have subscribed our Names as Witnesses thereto in his presence and at his Request ____S Lobb___F.Forby____M.Cocksedge
This Will was proved at London the twenty sixth day of August in the Year of our Lord One thousand seven hundred and fifty six before the Right Honourable Sir George Lee Knight Doctor of Laws Master Keeper or Commissary of the prerogative Court of Canterbury lawfully constituted by the Oaths of William Harvey and Leonard Wheasenham the Executors named in the said Will to whom Administration was granted of all and singular the Goods Chattels and Credits of the Deceased they having been first sworn by commission duly to administer / Exd
