Will of Henry Helsham of Stoke Ferry, Norfolk, who died 1806.

I Henry Helsham of Stoke Ferry in the County of Norfolk Surgeon and Apothecary being of sound and disposing mind and memory do make my last Will and Testament in manner following that is to say first I do hereby confirm and desire the bond or bonds or any other Security or Securities given by me or my late dear father deceased to be in Trust for my dear Wife Catherine Helsham upon our marriage to be first paid and satisfied out of my real or personal Estate hereinafter mentioned Also I give and bequeath unto my said dear Wife such part of my household furniture as she shall think proper to take for her own sole use and benefit as shall be estimated by my Executors hereinafter named at the Sum of two hundred pounds And I also give and bequeath to my said dear wife exclusive of such furniture all my plate plated Goods China Books Wine and household linen to be delivered to her as soon as may be after my decease Then I give devise and bequeath unto the Reverend Robert Forby of Fincham in the County of Norfolk and the Reverend George Millers of Ely in the Isle of Ely and County of Cambridge and to their heirs Executive And Administrators All and singular my Messuages Lands Tenements and hereditaments whatsoever situate lying and being in Stoke Ferry aforesaid or in any other parish or place thereto or near adjoining And also all and every my personal Estate and Effects whatsoever and wheresoever and of which nature so ever except as hereinbefore mentioned  Upon Trust that they the said Robert Forby and George Millers or the Survivor of them or the heirs Executors or Administrators of such Survivor so and shall as soon as conveniently can be or at least within eighteen months next after my decease sell and dispose of by public Auction or otherwise as they shall think proper All and singular the said Messuages lands tenements and hereditaments And also of my professional situation personal Estate and Effects whatsoever and wheresoever except such part thereof as I have hereinbefore disposed of for the best price or prices that can be had or got for the same and the money arising from such sale or sales together with the Rents and Profits of my said real Estate from the Time of my decease till the time of sale after payment of the charges and expenses attending the same my just debts and funeral expenses which I hereby direct shall be paid out of my personal Estate.  I will and direct that the said Robert Forby and George Millers or the Survivor of them or the heirs Executors or Administrators of such Survivor shall and do invest the same in the public funds or place the same out upon good and sufficient real or personal securities as they shall  think proper And so and shall pay and apply the dividends Interest or Proceeds thereof or any part of the said Trust monies in the Education maintenance and for the advancement in life of all and every my dear Children equally and ultimately without preference to any and of such Children until they shall attain their respective Ages of twenty one years or day of marriage And on their respectively attaining such Age or marrying with the Approbation of my said Trustees or the Survivor of them or the heirs Executors or Administrators of such Survivor Then I do hereby direct the said Robert Forby and George Millers or the Survivor of them or the heirs Executors or Administrators of such Survivor to pay one full and equal share of the said Trust monies to such Child And in case any of my said Children shall happen to die before his or her share of the Trust monies shall become payable then I do hereby direct my said Trustees or the Survivor of them or the heirs Executors or Administrators of such Survivor to pay the share of him or her so dying unto the survivors or survivor of them And in case all my said Children except one shall happen to die before his or her share shall become payable  then I do hereby direct that the share or shares of him her of them so dying shall be paid to such only Child at the period aforesaid or to his or her Executors or Administrators And I do hereby declare that the Receipt or Receipts of my said Trustees or the Survivor of them or the heirs Executors or Administrators of such Survivor shall be a sufficient discharge or discharges to the purchaser or purchasers of my said real Estate for the monies for which such receipt or Receipts shall be given And that such purchaser or purchasers shall not be obliged to see to the Application nor be answerable or accountable for the misapplication or nonapplication of such purchase monies And I will and direct that the necessary conveyances and Assurances of my said Estates on the sale or sales thereof as aforesaid shall be executed by the said Robert Forby and George Miller or the Survivor of them or the heirs Executors or Administrators of such survivor without any other person or persons joining therein and be considered and taken and as valid and effectual in the law to all Interests and purposes whatsoever as if I were living and actually executed the same myself And lastly I do hereby appoint the said Robert Foreby and the said George Millers Executors of this my Will and do revoke all  former Wills by me heretofore made And declare this to be my last Will and Testament in Witness whereof I the said Henry Helsham have hereunto set my hand and Seal this thirteenth day of May in the year of our Lord One thousand Eight hundred and five - Henry Helsham A Signed sealed published and declared by the said Henry Helsham the Estator as and for his last Will and Testament in the presence of us who in his presence and at his request and in the presence of each other have hereunto subscribed our names as Witnesses hereto

This Will was proved at London on the tenth day of June in the Year of our Lord One thousand Eight hundred and six before the Right Honourable Sir William Wynne Knight doctor of Laws Master keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oaths of the Reverend Robert Forby and George Millers Clerks the executors named in the said Will to whom Administration was granted of all and Singular the Goods Chattels and Credits of the deceased they having been first sworn by Commission only to admin

This Will was proved at London on the sixteenth day of September in the Year of our Lord One thousand Eight hundred and six before the Right Honourable Sir William Wynne Knight doctor of Laws Master keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oaths of the Reverend Robert Forby and George Millers Clerks the executors named in the said Will to whom Administration was granted of all and Singular the Goods Chattels and Credits of the deceased they having been first sworn by Commission only to admin The probate of the said Will of the said deceased granted in the Month of June last to the said Executors under the Sum of three thousand five hundred pounds having been voluntarily brought in and declared null and void.
